Terms of Service

Welcome to Frequency. These Terms of Service (“Terms”) are a binding agreement between you and Frequency (“Frequency,” “we,” “us,” or “our”) governing your access to and use of the Frequency website, applications, and services (together, the “Service”). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. About Frequency
Frequency is a discovery platform that helps people find, save, and request bookings at wellness places — such as studios, spas, and clinics — based on recommendations from the friends and creators they trust. Frequency is a discovery and referral service. We are not a provider of wellness, fitness, beauty, or medical services, and we do not employ or control the businesses listed on the Service. Any services you book are provided by the independent business, not by Frequency.
Nothing on the Service is medical advice. Content about wellness, fitness, skincare, or medical-spa services is for general informational purposes only and is not a substitute for professional advice, diagnosis, or treatment. Always consult a qualified provider before starting any treatment or program.
2. Eligibility
You must be at least 18 years old to use the Service. Frequency is currently offered as a private, invite-only beta, and access may be limited, changed, or withdrawn at any time. By using the Service you represent that you meet these requirements and that the information you provide is accurate.
3. Your Account
You sign in using a magic link or a third-party sign-in (such as Google). You are responsible for activity that occurs under your account and for keeping your access secure. Notify us promptly at hello@joinfrequency.io if you believe your account has been used without your permission.
4. Content You Provide
The Service lets you create content — including your profile, storefront, the places you save or recommend, quotes, ratings, and the friends or contacts you add. You retain ownership of the content you submit. You grant Frequency a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute that content for the purpose of operating, providing, and promoting the Service (for example, showing your public storefront at a /c or /u link).
You are responsible for your content and represent that you have the rights to share it and that it does not violate any law or third-party right. When you add a friend or contact’s information, you represent that you have their permission to share it with us for the purposes described in our Privacy Policy.
5. Businesses and Listing Claims
If you claim or submit a business listing, you represent that you are authorized to act on behalf of that business. Claims are reviewed before a listing is connected to your account, and we may approve, reject, or revoke a claim at our discretion. You are responsible for the accuracy of the listing information, availability, and booking details you provide.
6. Bookings and Third-Party Services
The Service may let you click through to a business’s booking page, send a request-to-book inquiry, or view availability provided through third-party booking systems (such as Mindbody, Vagaro, or Mariana Tek). Any appointment, payment, cancellation, refund, no-show, or service obligation is solely between you and the business. Frequency is not a party to those transactions and is not responsible for them. Third-party platforms are governed by their own terms and privacy policies.
7. Connecting Social Accounts
You may connect a TikTok or Instagram account to display your handle and follower count on your storefront. When you do, you authorize us to access limited information from that platform as described in our Privacy Policy. Your use of those platforms remains subject to their terms, and your use of TikTok data through Frequency is also subject to TikTok’s applicable developer and user terms. You can disconnect a social account at any time.
8. Acceptable Use
You agree not to:
- use the Service for any unlawful, harmful, or fraudulent purpose;
- impersonate any person or business, or claim a listing you are not authorized to claim;
- post content that is false, infringing, defamatory, harassing, or obscene;
- scrape, harvest, or collect data from the Service except as expressly permitted;
- interfere with, disrupt, or attempt to gain unauthorized access to the Service;
- send spam or unsolicited messages to other users or businesses through the Service.
9. Intellectual Property
The Service, including its software, design, and the “Frequency” name and branding, is owned by Frequency and protected by intellectual-property laws. Except for the rights expressly granted to you, we reserve all rights in the Service.
10. Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that listings, availability, ratings, or recommendations are accurate, complete, or current, or that the Service will be uninterrupted or error-free. We do not endorse or guarantee any business, treatment, or outcome.
11. Limitation of Liability
To the fullest extent permitted by law, Frequency and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or related to your use of the Service. To the fullest extent permitted by law, our total liability for any claim relating to the Service will not exceed one hundred US dollars ($100).
12. Indemnification
You agree to indemnify and hold harmless Frequency and its affiliates from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your content, your use of the Service, or your violation of these Terms or any law or third-party right.
13. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, including for violation of these Terms. You may stop using the Service at any time. Sections that by their nature should survive termination will survive.
14. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the “last updated” date above. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
15. Governing Law
These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. You agree that any dispute relating to the Service will be resolved in the state or federal courts located in New York County, New York, and you consent to their jurisdiction.
